\n\t\t\t\t\t\t\t\t\t1. Subject of the Agreement<\/strong>\n

Upon payment of the membership fee, Oktopus Fitness Club (\u201cOktopus\u201d) shall provide the Club Member with sports and wellness services.<\/p>\n\n2. Unified Agreement<\/strong>\n

These Terms & Conditions (\u201cService Agreement\u201d), the Privacy Policy available on the Oktopus platform, and, if applicable, consent to marketing communications together form a single, unified framework agreement. This agreement remains in force indefinitely, regardless of the duration of any specific membership.<\/p>\n\n3. Purchase of a New Membership<\/strong>\n

Each time the Club Member pays for a chosen membership, the parties shall be considered to have reached an agreement without the need to sign any additional document. These Terms & Conditions apply to all memberships purchased by the Club Member.<\/p>\n\n4. Amendments to the Framework Agreement<\/strong>\n

Oktopus reserves the right to amend the framework agreement at any time. The Club Member will be notified at least 10 (ten) days in advance through one of the communication channels provided or via the Oktopus platform. If the Member does not agree with the amendments, they must inform Oktopus and request termination of the framework agreement. Continued use of the membership constitutes acceptance of the amendments.<\/p>\n\n5. Dispute Resolution<\/strong>\n

Any disputes between the parties shall be resolved through negotiation. If no agreement is reached, the dispute shall be reviewed by the courts of Georgia.<\/p>\n\n6. Applicable Law<\/strong>\n

All matters not regulated by this Agreement shall be governed by Georgian law.<\/p>\n\n7. Termination Policy<\/strong>\n

\nIf the membership was purchased physically<\/strong> at the club\u2019s reception, the Member has no right to terminate the Agreement or request a refund.
\nIf the membership was purchased remotely<\/strong> (through any channel), the Member may cancel the Agreement within 14 days and request a refund.
\nIf the membership has been used at least once, the refundable amount will be reduced proportionally based on the days used.
\nTo receive a refund, the Member must provide proof of payment and submit a refund request.\n<\/p>\n\n8. Health Condition<\/strong>\n

The Club Member assumes full responsibility for their health condition and confirms that they have no medical issues preventing physical activity.<\/p>\n\n9. Rules, Regulations, and Schedule<\/strong>\n

The Member agrees to comply with all Club rules, regulations, and the schedule established by the administration. This information may be communicated through posted notices or verbally. The administration may modify rules as needed.<\/p>\n\n10. Transfer of Membership<\/strong>\n

Transferring the membership to a third party is strictly prohibited.<\/p>\n\n11. Access Control<\/strong>\n

\nThe Member must purchase an access card, sticker, or wristband.
\nThey must scan it upon entry and exit.
\nSharing the access card is prohibited.
\nIf the card is used by another person, the Club may suspend or cancel the membership at any time.\n<\/p>\n\n12. Membership Upgrade\/Change<\/strong>\n

The Member may upgrade or change their membership to a longer or more expensive plan by paying the price difference.<\/p>\n\n13. Lockers<\/strong>\n

\nThe Club may remove items left in lockers overnight.
\nThe Member releases the Club from liability for lost or damaged items.
\nStoring illegal, hazardous, toxic, or flammable items is prohibited.\n<\/p>\n\n14. Valuables<\/strong>\n

The Club strongly advises Members not to bring valuables. The Club is not responsible for loss, theft, or damage of such items anywhere on Club premises.<\/p>\n\n15. Children<\/strong>\n

\nChildren aged 4 and above may train at the Club.
\nRegistration of minors requires parental consent and proof of identity.
\nChildren aged 4\u201316 must train with a personal trainer.\n<\/p>\n\n16. Group Classes<\/strong>\n

\nPre-registration is mandatory.
\nLatecomers will not be admitted.
\nMembers must comply with all group class rules.\n<\/p>\n\n17. Membership Freeze<\/strong>\n

    \n
  • 1-month membership: 1 freeze, up to 5 calendar days<\/li>\n
  • 3-month membership: 3 freezes, each at least 5 calendar days<\/li>\n
  • 6-month membership: 4 freezes, each at least 5 calendar days<\/li>\n
  • 12-month membership: 7 freezes, each at least 5 calendar days<\/li>\n<\/ul>\n\n18. Behavior in the Club<\/strong>\n

    \nMembers must respect others\u2019 personal space.
    \nAggressive, offensive, or dangerous behavior is prohibited.
    \nEntering the Club under the influence of alcohol or drugs is strictly prohibited.
    \nThe Club may suspend or cancel membership and\/or contact authorities in such cases.\n<\/p>\n\n19. Dress Code<\/strong>\n

    \nMembers must wear proper sports clothing and footwear.
    \nTraining in outdoor clothing or footwear is prohibited.
    \nTraining without a shirt is not allowed.\n<\/p>\n\n20. Photo\/Video Recording<\/strong>\n

    \nRecording in changing rooms or private areas (e.g., spa rooms) is strictly prohibited.
    \nRecording is also prohibited in pool areas and group classes if any other person appears in the frame.\n<\/p>\n\n21. External Trainers<\/strong>\n

    Training by individuals not employed by the Club, including online personal training, is strictly prohibited inside the Club.<\/p>\n\n22. Video Surveillance<\/strong>\n

    The Member acknowledges that the Club uses video surveillance for security. Recordings are stored for 14 calendar days.<\/p>\n\n23. Membership Cancellation<\/strong>\n

    The Club reserves the right to suspend or cancel the membership at any time if the Member violates Club rules or regulations.<\/p>\n\n24. Pets<\/strong>\n

    For safety reasons, pets are not allowed inside the Club premises.<\/p>\n\n25. Liability<\/strong>\n

    \nThe Member assumes full responsibility for improper or negligent use of equipment.
    \nThe Club, its founders, and employees are not liable for damages caused by the Member\u2019s actions.
